JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE C.V. NAGARJUNA REDDY WRIT PETITION No.35804 of 2014 Dated: 25.11.2014 Between:
N. Sathaiah .. Petitioner and The State of Telangana, Rep. by its Principal Secretary, Civil Supplies Department, Secretariat, Hyderabad, and others.
.. Respondents Counsel for the petitioner: Mr. Ramesh Kumar Boddu Counsel for respondents 1 to 3: G.P. for Civil Supplies (TS) The court made the following:
ORDER:
This writ petition is filed with the grievance that respondent No.2 (Collector (CS), Ranga Reddy District) has not been considering the petitioner’s request for release of his Tata Ace vehicle bearing registration No.AP29 W 0509, which was seized along with 30 bags (50 kgs. each) of wheat on 29.10.2014.
A perusal of the record shows that in response to the notice dated 15.11.2014 issued under Section 6-B of the Essential Commodities Act, 1955, by the Collector (CS), Ranga Reddy District, the petitioner has submitted his explanation in the form of reply notice. The petitioner has not filed proof of his making an application seeking release of the seized vehicle. In the absence of filing such application, I am not inclined to entertain the writ petition at this stage. However, the petitioner is permitted to make an application in writing for release of the seized vehicle. Within three days from the date of receipt of such application, respondent No.2 shall consider the same, pass an appropriate order and communicate the same to the petitioner.
Subject to the above observation and direction, the writ petition is disposed of.
As a sequel to the disposal of the writ petition, W.P.M.P.No.44817 of 2014 shall stand disposed of as infructuous.
