ORDER:
This writ petition is filed for a mandamus to declare the action of respondent No.4 in not releasing essential commodities to the petitioner for distribution for the month of December, 2014 as illegal and arbitrary.
On 26.11.2014, in view of the serious allegations made by the petitioner that under political influence, respondent No.4 has withheld the supplies to the petitioner, respondent No.4 was directed to be personally present. Accordingly, she is present today. She has placed before the Court a copy of proceedings in Rc.No.635/2014/CSDT, dated 01.12.2014, addressed to the learned Government Pleader for Civil Supplies, wherein she has stated that as the petitioner has not remitted demand drafts for the months of October and November, 2014, another dealer was kept in-charge and that as the petitioner has remitted demand draft for the month of December, 2014 on 28.11.2014, she has issued release order on 28.11.2014 itself.
Though this Court is not prepared to accept the stand of respondent No.4 that the petitioner has not submitted the demand drafts for the months of October and November, 2014 in view of the assurance given by her that she will not repeat her conduct in future and the release order was already issued for December, 2014 the writ petition is closed with a warning to respondent No.4 not to repeat such conduct in future.
As a sequel to disposal of the writ petition, W.P.M.P.No.45119 of 2014 shall stand disposed of as infructuous.
