THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Heard Sri K.Lakshmikanth, learned Counsel for the petitioner.
2. Petitioner is defendant No.4 before the trial Court. The suit is of the year 2006. Initially he was placed ex parte. By an order dated 25.10.2007, he was permitted to file written statement. After lapse of eleven years from the date of institution of the suit, he filed an application under Order 18 Rule 7 and Section 151 of CPC to reopen the case and permit him to lead his evidence. The said application was rejected. After changing his advocate, the petitioner has again filed the instant application seeking the very same relief.
3. The learned trial Judge has recorded that the petitioner has filed a subsequent self same application though his earlier application for identical relief was dismissed.
4. Admittedly, from the date of institution of suit, eleven years have elapsed. To a query posed by this Court as to the stage of the suit, learned Counsel for the petitioner submitted that the suit now is set down for arguments. In the circumstances, no exception can be taken to the order impugned in this writ petition.
5. Resultantly, this writ petition fails and is accordingly dismissed. No costs.
