Heard learned counsel for the petitioners, Sri Sunil Kumar Singh, learned Standing Counsel appearing for the Gaon Sabha-respondent no.2 and the learned Standing Counsel appearing for the State-respondents.
The petitioner are before this Court for a direction to the Civil Judge, Hawali (Junior Division), Varanasi to decide the temporary injunction application 6-C in Original Suit No.1246 of 2020 (Nand Mohan Yadav @ Nattha and another Vs. State of U.P. and others), within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law, if possible, on the next date fixed in the matter after hearing all the parties concerned. If on account of any reason no orders are passed on the aforesaid date, the decision will be taken on the aforesaid application preferably within a period of 15 days, thereafter.
