This Regular First Appeal coming on for Hearing this day, the Court made the following:

2. Learned counsel from both side present.
3. Learned counsel for the appellants files a memo, stating that due to the death of second appellant, the appeal stands abated since the second appellant was held personally liable in the impugned judgment.
4. Learned counsel from both side submit that in view of the fact that the Legal Representatives of the second appellant have not been brought on record and the appeal of the second appellant has already been treated as abated vide order dated 17-10-2017, the main appeal itself stands abated.
5. In view of the memo and the submission made by both side as above, the appeal stands abated.
