JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 41819 of 2003 Petitioner :- Nand Lal Respondent :- State Of U.P. And Others Counsel for Petitioner :- Kamlesh Shukla Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
"(i) issue a writ, order or direction in the nature of mandamus commanding the respondents to ensure payment of salary to the petitioner as revised by Government Order dated 20.07.2001 whereby the pay scale of the Head Masters of Junior High Schools and other teachers has been brought at par with the Central Government employees and other along all other consequential benefits accrued to the petitioner since November 1997 on account of his being senior, within a week from the date a certified copy of the order of this Hon'ble Court is produced before them.
(ii) issue a writ, order or direction in the nature of mandamus commanding the respondents to consider and decide the representations of the petitioner preferred by him representations dated 08.12.1994, 24.11.1995 and 01.10.1996 and set right the anomalies, as pointed out therein by placing the petitioner at appropriate position in the Seniority List.
(iii) issue a writ, order or direction in the nature of mandamus commanding the respondents to pay the revised pay scale of Rs.10,000-15200 of Group 'A' to the petitioner, which has already been provided to the juniors."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
