Heard learned counsel for the petitioners and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.2-Sub Divisional Magistrate, Handiya, District Allahabad to expedite and decide the case no. T20160203041615 under Section 116 of U.P. Revenue Code, 2006 within stipulated time.
The contention of learned counsel for the petitioners is that respondent nos. 3 to 5 filed a suit for partition under Section 116 of U.P. Revenue Code, 2006 in the year 2016, in which evidence is going on.
Under these circumstances, respondent no.2-Sub Divisional Magistrate, Handiya, District Allahabad is directed to decide the case no. T20160203041615 filed under Section 116 of U.P. Revenue Code, 2006 as expeditiously as possible preferably within a period of nine months from the date of production of certified copy of this order without granting any unnecessary adjournment to either of the parties.
With the aforesaid direction, the writ petition stands disposed of.
