Disciplinary proceedings were initiated against the petitioner resulting in passing of an order dated 14.8.2017, imposing punishment of withholding three annual increments with cumulative effect. It is stated that the allegations against the petitioner, at best, warranted imposition of minor punishment and procedure contemplated for award of major punishment has not been followed. Submission is that the petitioner has, otherwise, retired from service and is suffering irreparable injury. All such issues have already been raised by the petitioner before the Addl.Director of Education (Basic) Allahabad but no decision has been taken.
Considering the fact that the petitioner is a retired person and his retiral benefits are withheld on such count, it would be appropriate to dispose of this petition with a direction upon the respondent no. 3 to examine the petitioner's grievance, raised before him, vide his representation dated 11.10.2017, by way of a reasoned order to be passed within a period of two months from the date of presentation of certified copy of this order. The issues urged before this Court shall specifically be considered by the authority while taking decision in the matter.
With the aforesaid observation, writ petition stands disposed of.
