Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed praying for quashment of Criminal Case No.3440 of 2003 (State Vs. Nand Lal Prasad), under Sections 409, 420, 467, 468 and 471 I.P.C., P.S. Jansa, District Varanasi, pending in the court of Special Chief Judicial Magistrate, Varanasi.
After arguing the matter at length, learned counsel for the applicant states that he does not want to press the present application.
Learned counsel for the applicant submits that applicant is government employee and he is still continuing in service and hence, in the facts of the present case, some protection may be granted to the applicant.
Considering the the facts of the present case, it is provided in case, applicant appears and surrender before the court below within three weeks from today and apply for bail, his prayer for bail shall be considered in view of the settled law by this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004(57) ALR 290 as well as judgment passed by the Hon'ble Apex Court reported in 2009 (3) ADJ 322 (SC) Lal Kamlendra Pratap Singh Vs. State of U.P.
For a period of two months, no coercive steps shall be taken against the applicant.
With the aforesaid directions, the application is disposed of.
