Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Additional Chief Judicial Magistrate, Court No.05, Allahabad to decide the Complaint Case No. 30 of 2017 (Nand Lal Pasi Vs. Sachendra Pratap Singh), under Section 138 of Negotiable Instruments Act, Police Station Jhunsi, District Allahabad within stipulated period.
Learned counsel for the applicant has submitted that the complaint has been filed by the applicant on 19.01.2017 and the proceeding has been pending since then and has been lingering- on, on one pretext or the other.
In view of the provision of Section 143(3) of the Negotiable Instruments Act, learned Additional Chief Judicial Magistrate, Court No.05, Allahabad is expected to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of four months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
