Heard Sri Rajesh Yadav, learned counsel for the petitioner, Mrs. Archana Singh, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing of the impugned FIR dated 5.5.2019, registered as Case Crime No.108 of 2019, under Sections 279, 238 I.P.C., Police Station Ganjdundwara, District Kasganj.
Learned A.G.A. has pointed out that the offence in question is a bailable one, to which learned counsel for the petitioner could not give a satisfactory reply.
After having examined the submissions advanced by learned counsel for the parties, we are of the opinion that no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the FIR as the offence in question is bailable one.
The petition lacks merit and is, accordingly, dismissed.
