Petitioner is working as Junior Assistant in the office of Deputy Commissioner, Commercial Tax, Hapur Mandal, Hapur. Grievance of the petitioner is that though he has completed 26 years of service but benefit of third promotion pay-scale as per ACP scheme has not been extended to him. With respect to the said grievance, petitioner has made a representation, which has been forwarded by respondent No.4, Deputy Commissioner (Administration), Commercial Tax, Hapur, to the appointing authority of petitioner on 13th June, 2018. Grievance is that even thereafter no decision has been taken in the matter.
Learned Standing Counsel states that petitioner's grievance can be considered by competent authority.
In the facts and circumstances of the case, this petition is disposed of permitting the petitioner to approach respondent No.3, i.e., Joint Commissioner (Executive) Commercial Tax, Ghaziabad, along with a certified copy of this order, within a period of two weeks from today. Petitioner shall be at liberty to annexe any other relevant material in support of his claim and the letter of Deputy Commissioner dated 13th June, 2018. The concerned authority shall examine petitioner's claim and pass appropriate order within a period of three months thereafter. All consequential action shall be taken, accordingly.
In view of above, writ petition stands disposed of finally.
