29th February 2012 ORAL ORDER Challenge is made to the notice dated 12th August 2011 issued under the instructions and order of the Court of learned Principal District Judge, Bharuch that the petitioner herein is directed to remain present in the proceedings of the Court Fees Reference No. 37/2008 to 462/2008 arising from Civil Misc. Application Nos. 16/2008 to 441/2008 & 459/2008. The main contention of the learned advocate for the petitioner is that the petitioner is an advocate in the said proceedings and the notice is required to be issued to the parties and not to the advocate in all the Court Fees References. He also submits that one such petition being Special Civil Application No. 12052 of 2008 has been preferred by one of the parties where challenge is made to the very Reference and the same has been appearing on the final hearing board. In such event, it will be desirable to fix Special Civil Application No. 12052 of 2008 for final hearing HC-NIC Page 1 of 2 Created On Wed Aug 12 02:30:06 IST 2015 SCA/14187/2011 2/2 ORDER st peremptorily on 21 March 2012. In the meantime, petitioneradvocate will be at liberty to move the trial Court to make a request to adjourn the matters and if such a request is made, the same shall be considered appropriately.
