HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.11348 of 2014 ORDER:
The case of the petitioner is that she is the absolute owner and is in possession of residential plots in Survey No.507/1A to an extent of Ac. 2.55 cents in Ward No.33, Palamaner Mandal, Chittoor District. The petitioner claims to have purchased the said property over a period of time. The petitioner traces the history of alienation of the property prior to the same was purchased by her. With an intention to dispose of the said property, the petitioner approached the Sub-Registrar, Palamaner, Chittoor District (4th respondent), but the Sub-Registrar refused to entertain the document. No reasons are assigned and no decision is communicated to the petitioner.
2. Having regard to the said submissions, the Writ Petition is disposed of giving liberty to the petitioner to present the Deed of Conveyance concerning the property to an extent of 12.342 square yards in Survey No.507/1A in Ward No.33, Palamaner Mandal, Chittoor District, and on presentation of the said Deed of Conveyance before the 4th respondent, the 4th respondent shall receive and process the same in accordance with the Registration Act, 1908 and the Indian Stamp Act, 1899. If the document is prohibited by any order of the Government or a notification, the same shall be specified and a decision to that extent be communicated to the petitioner. Such exercise shall be completed within two (2) weeks from the date of presentation of the document. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
