Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to permit the petitioner to retire from service from 31.01.2001 onwards and pay all the due pensionary benefits to him continuously.

O R D E R The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the first respondent to permit the petitioner to retire from service from 31.01.2001 onwards and to pay all the due pensionary benefits to him continuously.
2. Today, when the matter is taken up for consideration, the learned Special Government Pleader appearing for the respondents produced a letter dated 01.09.2017 stating that the petitioner was allowed to retire from service on 31.01.2001. Thereafter the petitioner died on 14.05.2011. Further, on 21.10.2013 all the pensionary benefits due to the petitioner was granted in favour of the petitioner and it was given to his wife. Accordingly, the writ petition has become infructuous.
3. In view of the above, this writ petition is dismissed as infructuous as nothing survives in this writ petition for adjudication. No costs. Consequently, the connected miscellaneous petition is also closed.
