THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Heard the learned counsel appearing for the petitioner/accused and the learned High Court Government Pleader appearing for the respondent-State.
2. The petitioner is charge sheeted by the respondent-police in respect of the offence punishable under sections 363, 376, 366, 313, 114, 511, 344, 368 r/w section 34 of IPC, Sections 4 and 6 of the POCSO Act and Section 9 of the Prohibition of Child Marriage Act, 2006 in Cr.No.119/2016.
3. During the pendency of the present petition, on the affidavit filed by the victim girl, the petitioner was granted interim bail. Learned counsel for the petitioner submits that in compliance of the direction of this Court while granting interim bail, today the petitioner has surrendered before the Special Court, Mandya.
4. Having regard to the distinguished circumstances of the case, there is no impediment to allow the petition.
The petition is allowed. Petitioner is enlarged on bail in Crime No.119/2016 of respondent-police, subject to the following conditions:
(i) He shall execute a self bond for a sum of Rs.50,000/- with one surety for the likesum to the satisfaction of the concerned Court.
(ii) He shall attend the Court on all hearing dates regularly and punctually.
(iii) He shall not terrorize the prosecution witnesses.
