JUDGMENT / ORDER

The petitioner has been directed by the third respondent to remove two shops that are functioning from a building owned by him bearing Door No.26/657 of the first respondent Municipality. The petitioner has preferred Exhibit P4 appeal against the said order, which is pending before the Municipal Council of the first respondent. The limited relief sought for by the petitioner is a direction to the first respondent to consider and finally dispose of Exhibit P4 appeal before coercive action is taken against the petitioner for implementing the direction to demolish the shop rooms. Advocate V.M.Kurian appears for the first respondent. 2. In view of the limited relief sought, I am satisfied that the direction sought for can be issued.
This writ petition is accordingly disposed of directing W.P.(C) No.24231 of 2014-D -:2:-
the Municipal Council to consider Exhibit P4 appeal in accordance with law and to finally dispose of the same, as expeditiously as possible and at any rate within a period two months of the date of receipt of a copy of this judgment, after affording an opportunity of being heard to the petitioner also. Pending final disposal of Exhibit P4, all coercive proceedings to demolish the shop rooms of the petitioner shall be kept in abeyance.
