The Civil Revision Petition is filed under Article 227 of the Constitution of India against the fair and decretal order dated 19.07.2016 made in EP.No.1509 of 2014 on the file of the IX Assistant City Civil Court, Chennai in ACP.No.42 of 2012 on the file of the Sole Arbitrator, Mr.N.Karthikeyan, Advocate, at Chennai.

The learned counsel for the petitioner would submit that after filing the Civil Revision Petition, the petitioner has received the communication dated 04.11.2017 issued by the respondent / decree holder addressed to the counsel appearing for the first respondent, wherein it has been informed not to proceed the case against the revision petitioner and proceed only against the borrower and co-borrower.
2. The said letter has been part and parcel of this order.
3. In the light of the above, there is nothing survives for adjudication. Therefore, the Civil Revision Petition is dismissed as infructuous. However, liberty is granted to the petitioner, if necessary, to file a petition at a later stage. Consequently, the connected miscellaneous petition is closed. No costs.
