ORDER:
This writ petition is filed for a mandamus to declare the action of respondent Nos.3 and 4 in not releasing essential commodities to the petitioner’s fair price shop No.31 of Pathagunta Village, Vedurukuppam Mandal, Chittoor District as illegal and arbitrary.
As the petitioner averred that her fair price shop authorisation is well in force and that despite obtaining demand draft for the value of the essential commodities on 22.11.2014, respondent no.4 has refused to receive the demand draft and allot the essential commodities for the month of December, 2014, on 15.12.2014, this Court directed respondent No.4 to be personally present. Accordingly, the Officer is personally present in the Court today. She has tried to convince this Court that the petitioner has not approached her with demand draft.
The petitioner has filed a copy of the demand draft for Rs.8,703/- which bears 22.11.2014 as the date.
In the light of this evidence, this Court cannot accept the stand taken by respondent No.4 that due to the default of the petitioner in producing the demand draft, essential commodities were not allotted. When the Court has confronted respondent No.4 with the above fact that the petitioner has obtained demand draft, she has stated that she will be careful in future and that she will continue allotment of stocks from the month of January, 2015.
In the light of the above facts and the statement made by respondent No.4 which is placed on record, the writ petition stands disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.48106 of 2014 shall stand disposed of as infructuous.
