THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.20305 of 2014 Dated : 21.07.2014 Between:

Petitioners And Government of Andhra Pradesh, Rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others .. Respondents This Court made the following :
THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.20305 of 2014 ORDER :
It is the case of the petitioners that their lands were acquired for the purpose of irrigation project. In that process, they were displaced from their village and an extent of Ac.0.05 cents each in Survey Nos.143, 141 and 450 situated in Gundlapalli Village, were allotted to them in 2006. When the petitioners intend to dispose of the said lands, the Sub-Registrar, Addanki, insisted No Objection Certificate (NOC) from the revenue authorities. Hence this writ petition.
2. Learned counsel for the petitioners submits that insistence of NOC from the revenue authorities is illegal and the deeds of conveyance be received and processed without insisting for NOC.
3. Learned Government Pleader for Revenue would submit that if the allottee is intend to dispose of the lands in question within a period of ten years from the date of allotment, he should obtain NOC from the Revenue Divisional Officer. He further submits that in view of the said condition, insistence of NOC is valid.
4. At this stage, learned counsel for the petitioners submits that the petitioners may be permitted to approach the Revenue Divisional Officer for granting NOC.
5. Accordingly, this Writ Petition is disposed of. The petitioners are at liberty to submit an application to the Revenue Divisional Officer for granting NOC. As and when such an application is made, the Revenue Divisional Officer is directed to consider the same and pass appropriate orders, in accordance with law, within a period of two weeks. No costs.
Consequently, Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
