The petitioner herein seeks a writ of mandamus directing proper and effective investigation on a complaint alleging destruction of huge quantity of dried ginger by fire at the dead of night. The petitioner is not satisfied with the investigation. Finding that investigation is not on the right track, he brought this writ petition. Now, the Deputy Superintendent of Police, Muvattupuzha (3rd respondent) has filed a detailed report that investigation is in progress at his hands, that earnest efforts are being made to detect the culprit, and effective investigation will definitely be made by him, without being influenced by any external pressure. His report also shows that he has already collected necessary materials which will guide him to detect the offender. Learned counsel for the petitioner submits that the confidence expressed by the investigating officer in his report can be accepted. I find that the proceeding can be closed, without prejudice to the right of the petitioner to seek appropriate relief Crl.M.C.. No. 5598/2014 2 at a later stage, if felt necessary. However, there can be a direction to the Deputy Superintendent of Police, Muvattupuzha to proceed with effective investigation and submit final report without any delay. In the result, this writ petition is closed, without prejudice to the right of the petitioner to seek appropriate relief at a later stage, if felt necessary, and with a direction to the 3rd respondent, that proper and effective investigation shall be made by him, without being influenced by any external factor or pressure, and final report shall be submitted without any delay.
