M.Visalatchi vs The Sub Registrar

Madras High Court|20 November, 2017

JUDGMENT / ORDER

The petitioner seeks for a mandamus to direct the respondent to register and release the Sale Deed dated 14.09.2015 vide pending Registration No.35/2015 and the Sale Deed dated 21.08.2015 vide Pending Registration No.36/2015 to the petitioner.
3. Heard Mr.K.Ganesh Kumar, the learned counsel for the petitioner and Mr.R.Govindasamy, the learned Special Government Pleader appearing for the respondent.
4. It is stated that the petitioner presented two sale deeds dated 14.09.2015 and 21.08.2015 executed by her father-in-law and they were assigned with Pending Registration Nos.35 /2015 and 36/2015 by the respondent. The grievance of the petitioner is that even though the said pending registration number was given to those documents as early in the year 2015, till this date, the respondent has not registered the documents and returned the same to the petitioner. It is further stated that the respondent has not passed any order so far and communicated the same to the petitioner as to why the registration has not been done so far. Therefore, the petitioner has approached this Court and filed the present writ petition.
5. Upon hearing the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondent, this Court is of the view that the respondent has to communicate the reason to the petitioner for not registering the document so far, if at all there are justifiable and legally sustainable reasons for not doing so.
6. In this case, it is seen that the respondent has not registered the document and also not communicated the reason for not registering the same so far. Therefore, without expressing any view on the merits of the claim made by the petitioner, I only direct the respondent to look into the matter and pass appropriate orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
