M.Vijayalakshmi vs State Of Kerala

High Court Of Kerala|24 October, 2014
|

JUDGMENT / ORDER

The petitioner approached this Court seeking the following reliefs. (i) declare that the petitioner is entitled to continue in the parent School without being deployed as she being an Associate NCC officer.
(ii) issue a writ of mandamus or other appropriate writ or direction commanding the respondents to permit the petitioner to continue in the parent school and also disburse her salary due from 15.07.2014.
2. The petitioner is working as UPSA in Mahatma Girls High School, Chennithala from 27.10.2006. As per the staff fixation order for 2014-2015, the post held by the petitioner was abolished for want of W.P.C. No.26340 of 2014 2 pupil/student strength and it is directed to transfer the petitioner to the Teachers Bank. In that circumstance, this writ petition is filed.
2. During the pendency of the Writ Petition, the petitioner had submitted Ext.P6 revision before the Director of Public Instruction, Jagathi seeking the benefit of G.O.P. No.403/2002/G.Edn dated 04.12.2002.
3. Learned counsel for the petitioner seeks an appropriate direction to the Director of Public Instructions to dispose of Ext.P6 and to permit her to continue in the same school till a decision is taken in the matter.
4. So far as a direction has already been issued by way of Ext.P2 to retrench the petitioner with effect from 15.07.2014 and include her in the Teachers Bank, I do not think that this Court will be justified in staying the proceedings pursuant to Ext.P2. However, I am of the view that this writ petition can be disposed of as under.
The Director of Public Instructions shall W.P.C. No.26340 of 2014 3 consider Ext.P6 and dispose of the same within a period of two months from the date of receipt of a copy of this judgment after hearing the affected parties.
