Heard Shri Mohd. Aslam Khan, learned counsel assisted by Shri Mohd. Mateen Khan, learned counsel for the petitioner and learned Standing Counsel for the State.
Supplementary affidavit filed on behalf of the petitioner is taken in the record.
The petitioner has prayed for the following relief:
"Issue a writ, order or direction in the nature of mandamus commanding and directing to the respondent no.2 Prescribed Authority/S.D.M. Dhampur to decide the Election Petition No. T 202113160303956 of 2021 Muzzafar Ali Vs. Tufail Ahmed and others Under Section 12-C of U.p. Panchayat Raj Act."
There is no good cause for this Court to prioritize the hearing of an election petition filed in the year 2021 over other matters pending before the tribunal below.
Faced with this, Shri Mohd. Aslam Khan, learned counsel assisted by Shri Mohd. Mateen Khan, learned counsel for the petitioner seeks leave to approach the election tribunal.
It is open to the petitioner to move an application for expediting the hearing of the election petition before the election tribunal. In case such application is moved, the same shall be decided by the election tribunal in accordance with law and as per its roster.
The writ petition is disposed of.
