JUDGMENT / ORDER

Learned counsel for the petitioner retired from service on 30.6.2000. At point in time, when the petitioner attained age of superannuation, no recovery proceedings/disciplinary proceedings were pending against him.
When the petitioner demanded release of gratuity amount, plea has been taken by the Managing Director, U.P. State Ware Housing Corporation, respondent no.2, that the petitioner had caused losses.
Respondent no.2 is directed to file his affidavit within fifteen days from today as to under what rule or legal authority graduity amount of the petitioner is being withheld.
