Sri Kanchan Singh has filed power on behalf of the applicant, which is taken on record.
Heard learned counsel for the applicant and Sri R.S.Parihar, learned A.G.A. appearing for the State and Sri Bharat Singh, learned counsel or the complainant.
Sri Bharrat Singh, learned counsel for the complainant submits that a compromise has been arrived at between the parties. Learned counsel for the applicant has no objection on the statement of Sri Bharat Singh and he has also conceded that a compromise has taken places as out of court settlement. It i also contended that co-accused namely Ali Khan has been enlarged on bail by Coordinate Bench of this Court on 30.11.2018, copy of which is annexed as annexure-9 on page 48 of the bail application. It has further been submitted that the applicant is languishing in jail since 7.4.2017. The applicant has no other reported criminal antecedent.
Learned A.G.A. opposed the prayer for bail, but could not dispute the submissions of the learned counsel for the parties.
Considering the submissions of the rival parties, it would be appropriate to enlarge the applicant on bail.
Without expressing any opinion on the merits of the case let the applicant Muwahid @ Bablu involved in Case Crime No 825 of 2015(S.T.No..118 of 2016), under Sections 307, 452, 504, 506 I.P.C., Police Station Alapur, District Badaun be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned with the following conditions.
1. The applicant will continue to attend and co-operate in the trial pending before the court concerned on the date fixed after release.
2. He will not tamper with the witnesses.
3. He will not indulge in any illegal activities during the bail period.
It is further directed that the identity, status and residence proof of the sureties be verified by the authorities concerned before they are accepted.
In case of breach of any of the above conditions, the trial court will be at liberty to cancel the bail.
