HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.15796 of 2011 ORDER :
The case of the petitioner is that he is the absolute owner and possessor of the land to an extent of Ac.3.32 cents in Sy.No.526 of Tirumalapuram Village, Jangareddygudem Mandal, West Godavari District. This writ petition is instituted aggrieved by the action of the respondents 2 to 4 in directing the petitioner to vacate from the land as the same is required by the respondents 2 to 4. The case of the petitioner is that without following due process of law, petitioner sought to be dispossessed from the property owned by him.
2. By order dated 10.06.2011, this Court directed the respondents not to interfere with the possession and enjoyment of the petitioner in respect of the land in question without following due process of law.
3. Counter-affidavit is filed on behalf of the 4th respondent deposed by Sri M.Mukkanti. In para 6 of the counter-affidavit, it is stated that petitioner having come to know about the notification under Section 4(1) of the Land Acquisition Act, 1894, instituted this writ petition. It is further stated that the petitioner will not be dispossessed from the land without following due process of law as contemplated by the Land Acquisition Act and without making payment of compensation. In view of the assertion made on behalf of the 4th respondent, no further orders are required in this writ petition and accordingly, the writ petition is disposed of.
Miscellaneous petition, if any, pending in this writ petition, shall stand closed. No costs.
