The petitioner challenging the order passed by the Land Tribunal filed appeal before appellate authority as AA.22/2007. This was dismissed for non prosecution. Thereafter petitioner filed application to restore the appeal with delay. The above applications were also dismissed. It is challenging the above orders of the appellate authority, this writ petition has been filed.
2. I am of the view the appeal shall be heard on merit. The appellate authority shall restore the appeal and dispose the same within three months after hearing the petitioner and respondents therein. If the petitioner fails to appear before the appellate authority it is open for the said authority to dispose of the matter on merit in the absence of the petitioner. The petitioner shall appear before the appellate authority on 4.11.2014. The appellate authority WP(C).No.27805/2013-A.
2 shall ensure that notice issued to the respondents in the appeal before the final decision is rendered in the appeal.
Writ petition is disposed of as above.
