JUDGMENT / ORDER

The petitioners herein are the six accused in C.C. No. 564/2012 of the Judicial First Class Magistrate Court-III, Thiruvananthapuram. An incident of campus fight between two student groups led to the registration of the crime under Sections 143, 147, 341 323 and 294 (b) IPC. The defacto complainant sustained injuries in the alleged incident. Crime in the said case was registered on the complaint of one Sreejith, who is the 2nd respondent herein. Petitioners seek orders quashing the prosecution, on the ground that they and the complainant have come to terms amicably out of court. The 2nd respondent has filed affidavit to the effect that he has settled the dispute with the accused, and that he has no grievance or complaint now. I am well satisfied that the whole dispute stands really settled, and that continuance of prosecution in such a situation will not serve any purpose, other than wasting the precious time of the court. The main offences under Section 341 and 323 are compoundable. Crl.M.C. No.6451 Of 2014 2 Orders are sought under Section 482 Cr.P.C., because the other offences are non-compoundable.
In the result, this Crl.M.C. is allowed. The prosecution as against the petitioners herein will stand quashed under Section 482 Cr.P.C. Accordingly, the petitioners will stand released from prosecution. The bail bond, if any, executed by the petitioners will stand discharged.
