Petition under Section 438 Cr.P.C. 2. According to the petitioner, he is apprehending arrest in connection with Crime No.256/2014 of Ponnani Police Station, registered for the offences under Sections 323, 344, 365, 376 and 506(ii) read with Section 34 of the Indian Penal Code. The learned Public Prosecutor submits that even though initially the petitioner was arraigned as the accused in the case, on investigation, he was removed from the array of the accused and presently, he is not an accused. At the same time, it has been pointed out that the vehicle of the petitioner was made use of, for committing the offence in the matter and therefore, the petitioner has to surrender the vehicle. Of course, the petitioner has to co-operate with the investigation and shall produce the vehicle for verification before the Investigating Officer.
With the above said observations, this bail application is dismissed.
