Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that there was love affair in between applicant and prosecutrix. She herself went along with applicant. However, since both were apprehended marriage could not be solemnized. Under pressure of family member she made allegation that physical relation was established against her wishes From perusal of statement, it appears that she was consenting party. According to medical report, she was aged about 18 years. However, the applicant is in jail since 30.4.2010.
In this view of the matter, without expressing any opinion on merits of the case, let the applicant namely, Mustakeem @ Raja be released on bail in Case Crime No. 181 of 2010, under Sections 363, 366 and 376 I.P.C., P.S. Noorpur, District Bijnore on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
