Heard Mr. Araf Khan, learned counsel for the applicants and learned Additional Government Advocate representing the State.
This application under Section 482 Cr.P.C has been preferred by the applicants with a prayer to set aside the impugned cognizance/summoning order dated 22.6.2019 passed by Chief Judicial Magistrate, Moradabad, charge sheet dated 30.5.2019 as well as entire proceedings of Criminal Case No. 5225 of 2019 (State of U.P. vs. Mustafa and others) arising out of Case Crime No. 44 of 2019, under Sections 498-A, 304-B, 506 IPC and Section 3/4 D.P. Act, police station Mugalpura, district Moradabad.
Learned counsel for the applicants at the outset submitted that on account of some developments in the matter, applicants do not want to press this application at this stage and they may be permitted to withdraw this application with liberty to file a fresh application at the appropriate stage.
The prayer so made by the learned counsel for the applicants is liable to be accepted.
In view of above, the present application is dismissed as not pressed with liberty to the applicants to file a fresh application at the appropriate stage.
