Heard S/Sri Mohammad Alam,Jai Prakash Prasad, learned counsel for the applicant and Sri T. Islam, learned counsel for opposite party no.2 and learned A.G.A. for the State and perused the material placed on record.
Present application under Section 482 Cr.P.C. has been filed with the prayer to quash the order dated 13.02.2017 passed by Additional Chief Judicial Magistrate, Rampur in Case No.119 of 2016 and the order dated 20.09.2018 passed by Additional Sessions Judge, Rampur in Appeal No.09 of 2017 (Musarrat Ali Khan Versus State of U.P. and another) under Section 12 of Protection of Women from Domestic Violence Act, 2005.
The applicant is husband of opposite party no.2 and retired Government employee having sufficient means to pay maintenance allowance and other expenses to the victim, opposite party no.2 who is his wife. The opposite party no.2 has preferred Criminal Revision No.31 of 2019 (Smt. Seema Parveen Versus State and another) against the orders impugned in this application. All the arguments raised by learned counsel for the applicant has been considered in the said revision and a detailed order has been passed therein and the revision has been allowed.
In view of above, the application under Section 482 Cr.P.C. has no merit and it is accordingly, dismissed.
