Heard Sri Raj Narayan Gupta, learned counsel for the petitioner, Sri Ashish Pandey, learned A.G.A. for the State and perused the record.
The writ petition has been filed with the prayer to conduct the fair investigation by the C.B.I. in pursuance of the case crime No.170 of 2014 under Section 363 IPC Police Station Hafizpur, Distrit Hapur.
It has been argued by the learned counsel for the petitioner that again on the second time after the direction for investigation in the case, Final report has been submitted and victim boy has yet not been recovered. It has further submitted that F.I.R. lodged against the unknown person.
Learned A.G.A. for the State has not disputed the aforesaid arguments argued by the learned counsel for the petitioner.
Considering the facts and circumstances of the case, the writ petition is disposed of with the direction that petitioner may challenge the final report before the appropriate forum if so advised.
