Heard learned advocate for the petitioner.

It is submitted that the learned Metropolitan Magistrate, Court No.15, Ahmedabad erred in passing order on 21.04.2012 below Exh.7 in Criminal Misc. Application No.33 of 2012 in exercise of powers under Section 97 of the Code of Criminal Procedure, 1973 by handing over child aged 2 and a half years to the husband and such order is even contrary to the welfare of the child.

Hence, notice returnable on 11.05.2012. Meanwhile, ad-interim relief in terms of paragraph No.15C is granted.
