Heard learned counsel for the applicant and Sri P.K. Giri, learned Additional Chief Standing Counsel and perused the affidavit filed in support of this application.
On 29.5.2019 following order was passed:-
"Pursuant to the order dated 15.5.2019 opposite party Sri Amit Kumar Pandey is present in the Court.
No affidavit of compliance has been filed, however, photocopies of the Cheque No. 109890 dated 29.5.2019 of Rs. 3 lakhs and Cheque No. 109891 dated 29.5.2019 of Rs. 3,000/- has been placed before this Court.
Sri P.K. Giri on instruction of Sri Amit Kumar Pandey states that the petitioner can collect these cheques from the office of the opposite party by tomorrow.
In such view of the matter, put up this case in the additional cause list on 31.5.2019. On which date learned counsel for the applicant is directed to make statement as to whether the amount has been collected by the applicant or not.
In case, the applicant or the counsel of the applicant is not present in the court, it will be presumed that the order of this Court has been complied with.
Personal appearance of opposite party is exempted for future dates unless ordered otherwise."
The present contempt application has been filed for punishing the Opposite Party for willful disobedience of the judgment and order dated 11.4.2018 passed by the Writ Court in Writ Petition No. 9748 of 2018.
Sri Giri has produced a copy of the photograph showing the applicant receiving the amount and also a copy of the receipt duly attested by the opposite party.
Learned counsel for the applicant admitted that the amount has been paid to the applicant and the order of the writ Court has been complied with.
In such view of the matter, this Court is of the opinion that the order of the Writ Court has been complied and no further orders are required. Notice stands discharged.
Application is consigned to record.
