Case has been called out twice.
Heard Sri M.A. Siddiqui, learned counsel for the petitioner and Sri Deepak Srivastava for B.S.A.
No counter affidavit has been filed inspite of repeated orders of this Court. Sri Deepak Srivastava appearing for B.S.A. has conceded before this Court that he had categorically informd the B.S.A., Faizabad that the counter affidavit is to be filed in this matter. He has handed over the copy of the petition to the B.S.A. in the month of May, 2010. The B.S.A. had told the counsel that he will contact immediately and get the counter affidavit prepared, since then he has not contacted with the counsel and the counsel is put in a very embarrassing position before this Court . Every time the case is taken up the counsel cuts a sorry figure because of indifferent attitude of the B.S.A. This Court has no option except to call for the Director, Basic Education for knowing the version of opposite parties.
Accordingly, let the Director and B.S.A. Faizabad appear before this court on 21.09.2010 alongwith record of the case to assist this Court in the matters.
