Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner has applied for the transfer of saw mill licence No.164/1994 which is in the name of his brother Mahmudul Hasan to his own name. The said application was submitted on 13.04.2018 to the Divisional Director, Social Forestry, Division Bareilly, respondent No.2.
The application for transfer of the saw mill licence is presently dealt with by the State Level Committee through the Principal Chief Conservation of Forest as his Chairman. The application is made online but the petitioner is unable to apply online for the reason that the website is not working.
Learned Standing Counsel submits that the previous application of the petitioner can be forwarded to the State Level Committee for consideration.
In view of the aforesaid facts and circumstances, we dispose of the writ petition with the direction to the respondent No.2 to forward the above application of the petitioner dated 13.04.2018 along with all documents to the respondent No.1 within a period of one month from today and the respondent No.1 on receipt on the said application and the documents shall consider the request of the transfer of the saw mill licence in accordance with law most expeditiously if possible within a period of next three months thereafter.
The Writ Petition is disposed of.
