… Respondents (By Sri Narendra Gowda, Advocate for R1 & R2; Sri E.S.Indiresh, AGA for R3) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to direct the respondents to allot 100% of the Land in favour of the petitioner in lieu of utilization of his Land Bearing Sy.No.13, Measuring 1.00 Acres Situated at Malgalu Village, Yeswanthpur Hobli, Bengaluru North Taluk and to direct the respondents to consider the representation dated 30.10.2015 made by the petitioner to respondent vide Annexure-L and etc.
This Writ Petition coming on for Preliminary Hearing in ‘B’ Group this day, the Court made the following:-
O R D E R Mr.K.Shashi Kiran Shetty, learned Senior Counsel for the petitioner.
Mr.Narendra Gowda, learned counsel for respondent Nos.1 and 2.
Mr.E.S.Indiresh, learned AGA for respondent No.3.
In this petition, the petitioner inter alia seeks a direction to the respondents to consider the representation dated 30.10.2015 submitted by the petitioner by a speaking order.
2. On the other hand, learned counsel for respondent Nos. 2 and 3 submitted that suitable action on the representation submitted by the petitioner shall be taken.
3. In view of the aforesaid submissions and in the facts of the case, the writ petition is disposed of with a direction to the competent authority of respondent Nos. 2 and 3 to consider and decide the representation dated 30.10.2015 submitted by the petitioner, if not already decided, by a speaking order within three months from the date of receipt of certified copy of the order passed today. It is made clear that this Court has not expressed any opinion on the merit of the case.
