Heard learned counsel for the petitioner; the learned Standing Counsel for the State-respondents 1 to 4; and perused the record.
The prayer in this petition is to command the Senior Superintendent of Police, Azamgarh to protect the life and liberty of the petitioners and to take necessary action against the concerned persons who are interfering in the peaceful possession of the petitioners over their Plot Nos. 120M; 352M; 565; and 399 at village Larpur, Pargana and Tehsil Nijamabad, District Azamgarh.
This petition has been filed by impleading respondent nos. 5 and 6 as persons who are allegedly interfering in the peaceful possession of the petitioners.
On 14.12.2020, the Court had required the learned Standing Counsel to obtain instruction.
Learned Standing Counsel has obtained instruction and has informed the Court that there is a dispute between the petitioners on the one side and the respondents 5 and 6 on the other which is engaging attention of the Court in Writ B No. 985 of 2020 instituted by the respondent nos. 5 and 6 wherein an interim order has also been passed staying the effect and operation of the order dated 03.07.2020 passed by the concerned authority of which the petitioners seek to take benefit.
As the dispute between two individuals is already engaging attention of the Court in Writ B No. 985 of 2020 and an interim order is also operating therein, we decline to entertain this petition. The petition is accordingly disposed off without prejudice to the right of the petitioners to move an application in the pending matter.
