Heard learned counsel for the petitioner, learned standing counsel for the State-respondents and perused the material available on record.
This petition for writ is preferred to have a direction for the respondents to consider and decide the claim / representation of the petitioner dated 12.6.2017, filed as Annexure No.2 to the writ petition.
Under the representation aforesaid the petitioner has sought a licence and also "No Objection Certificate" to operate a saw mill.
As per Rule 4 of the U.P. Establishment and Regulation of Saw-Mills Rules, 1978 any person desiring to establish, erect or operate any existing saw-mill shall make an application in that behalf to the Divisional Forest Officer concerned for obtaining a licence in the form given in the Schedule I appended to these Rules. The application submitted by the petitioner is not in the prescribed proforma that demands certain particulars with regard to production capacity of the proposed saw-mill and also the details with regard to availability of the machinery and power etc. No such details are given by the petitioner in the representation dated 12.6.2017. No Objection Certificate by the District Magistrate too has not been annexed with the application aforesaid.
In view of the deficiencies noticed above, there was no need for the respondents to consider and decide the representation. The petitioner has not submitted any application as per the requirements of the Rules of 1978.
The writ petition stands dismissed as above.
