1. Heard Sri Ram Janam Shahi, learned counsel for the applicants and Sri Ashwani Prakash Tripathi, learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicants - Murali Yadav, Durga Prasad and Durgvijay Yadav, seeking anticipatory bail in Case Crime No.132 of 2021, under Sections -147, 323, 504, 506, 308 I.P.C., Police Station - Kotwali, District - Azamgarh, during pendency of trial.
3. The fact allegations made in the FIR are prima facie supported by the injury report. As to the exact role and the extent of injury, it may remain open to the applicants to raise those issues in other proceedings including regular bail application. Insofar as the occurrence appears to have been caused, no interference is warranted.
4. Accordingly, the present application is rejected. However, in the event of regular bail application being filed at the appropriate stage, it is expected that the same may be decided as expeditiously as possible, without being prejudiced by any observation made in this order.
