This appeal is preferred by the plaintiff in O.S.No.98 of 2013 on the file of the Sub Court, Pala. The matter was referred for mediation as per order dated 11.08.2014 and it is reported that the matter is settled at the mediation. The settlement arrived at in the mediation is part of the records.
2. In the light of the settlement arrived at between the parties at the mediation, the decree and judgment impugned in the appeal are set aside and the suit, O.S.No.98 of 2013 on the file of the Sub Court, Pala is remitted to the trial court for passing a decree in terms of the settlement arrived at between the parties. A copy of the memorandum of settlement shall be appended to this judgment and the original shall be preserved.
3. In view of the provisions contained in section 69A of the Kerala Court Fees and Suits Valuation Act, 1959, the court fee paid by the appellant in this appeal shall be refunded.
