Heard learned counsel for the petitioner and Shri Ram Babu Yadav for the Gaon Sabha, respondent no.4 as also learned Standing counsel for the State-respondents.
By means of this Public Interest Litigation, petitioner complains of unauthorized encroachment by private respondents 5 to 10 over plot no.101 area 0.063 hectare situated in village Manikpur, Tehsil Chunar, District Mirzapur.
Learned Standing counsel on the basis of the instructions received, copy whereof is taken on record, has submitted that the proceedings under Section 67(1) of the U.P. Revenue Code, 2006 for dispossession of the unauthorized occupants has already been instituted and that the same shall be concluded within a period of two months.
The writ petition is disposed of directing the State-respondents to conclude the proceedings under Section 67(1), which have been drawn against the encroachers expeditiously and preferably within a period of three months from the date a certified copy of this order is filed before them.
