Muqeemuddin S/O Kamaluddin vs State Of U.P. Thru Secy. Home & Ors.

High Court Of Judicature at Allahabad|19 January, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioner and the learned Additional Government Advocate.
In this petition the prayer has been made with respect to quashing of non- cognizable report No. 93 of 2009, under Sections 323 and 504 IPC, registered at police station Ibrahimpur, district Ambedkar Nagar, which has subsequently been converted into case crime no. 732 of 2009, under Sections 325, 323, 504 IPC read with Section 3 (1) (X) SC/ST Act.
Argument advanced by the learned counsel for the petitioner is that since at the initial stage the case was registered under Section 323 and 504 IPC being a non-cognizable report, as such, without permission of the Court the matter cannot be investigated by the police.
We have gone through the report impugned annexed as Annexure-1 to the petition from which it comes out that one Manjeet Kumar has received injuries not only on his head but also on other parts of the body.
Let injury report be brought on record by the learned counsel for the petitioner by means of a supplementary affidavit within two days.
As prayed, list/put up on 25th January, 2010.
Order Date :- 19.1.2010 Chauhan/-
