Heard learned counsel for the petitioners and learned Additional Government Advocate.
The present writ petition has been filed with the prayer for quashing First Information Report relating to Case Crime no. 648 of 2010 under Sections 498-A, 323, 504 & 506 IPC read with Section 3/4 of the Dowry Prohibition Act of Police Station Kotwali Nagar, district Barabanki.
We have gone through the contents of the First Information Report. Since the allegations made in the First Information Report disclose commission of cognizable offence, as such, the same cannot be quashed.
The writ petition is accordingly dismissed.
However it is provided that if petitioners No. 1 to 5, i.e. Muqaddasi Begum, Smt. Samana, Smt. Shahana, Smt. Shabana and Smt. Nahid surrender before the Court below and move application for bail, they being ladies, their bail application shall be considered and disposed of expeditiously giving them the benefit of Section 437 Cr.P.C.
It is further directed that petitioners No. 6 and 7 i.e. Tahskeel Zaidi and Rajjan alias Maroof Hasan surrender before the court below and move application for bail, their bail application shall be heard and disposed of expeditiously by the Courts below.
