This petition has been filed alleging inaction on the part of the respondents to implement the report of investigation, which indicates failures and lapses in the matter of recruitment of some officials of the University.
Learned counsel appearing for respondent Nos. 2 and 3 submits with an affidavit that pursuant to the investigation report, action has been taken. We set out the relevant portion of the affidavit.
“It is submitted that it is not true to submit that the University has not taken any action on the basis of the reports of the committees. Basing on the said reports, the Executive Council issued charge sheets under the proceedings of the Executive Council No. AKNU/Legal matters/2010-12, dated 16.9.2013 and after receipt of the explanations from all the persons, the Executive Council appointed under proceedings dated 18.11.2014, Hon’ble Mr. Justice A. Gopala Rao, former judge of this Court as an Inquiry authority and the proceedings have been commenced and on 27.12.2014 a preliminary meeting was fixed by the learned Inquiry Authority. On completion of the said proceedings, depending upon the outcome, appropriate proceedings will be taken by the Executive Council in this regard in accordance with law.”
In view of the aforesaid stand of the respondents, we think that this Court is not inclined to interfere with this matter. However, this Court hopes that the learned enquiry officer will take a decision at an early date. Let the decision be taken within a period of six months from the date of communication of this order.
The Public Interest Litigation is accordingly disposed of.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs.
