Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Munshi who is involved in Case Crime No. 75 of 2018, under Section 18/20 NDPS Act, Police Station-Gandhi Park, District-Aligarh.
As per prosecution version, on 18.2.2018 at about 8:00 AM, applicant was arrested by the police and recovery of 150 gram diazepam powder has been made from him.
Learned counsel for the applicant contends that before this arrest, there is no criminal antecedents against the applicant. He further contends that applicant has been made accused in one other case at case crime no. 5 of 2018 under Section 3/5/8 Cow Slaughter Act alongwith the present case. Lastly, learned counsel for the applicant contends that there is no public witness of the alleged recovery and the applicant is in jail since 18.2.2018.
Learned A.G.A., has opposed the prayer for bail.
The alleged recovery of diazepam powder is below the commercial quantity.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Munshi, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
Application stands allowed.
