Petitioner retired on attaining the age of superannuation on 31 January 2018.
By the instant writ petition, petitioner seeks following relief:
i) issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to pay the amount of gratuity and pension of the petitioner, which fell due on the retirement of the petitioner.
Learned Standing Counsel on instructions received from the office of the Sub Divisional Magistrate, Mau, District Chitrakoot, submits that the papers pertaining to the post retiral dues of the petitioner has been forwarded on 26 April 2019, to the office of the newly impleaded respondent.
In view thereof, on consent, the petition is disposed of directing the fourth respondent-Additional Director Treasury and Pension, Chitrakoot Division, Banda, to consider and decide the claim of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order alongwith copy of the writ petition failing which petitioner shall be entitled to interest @ 6.5% per annum on the sum from the due date.
It is clarified that the Court has not considered the claim of the petitioner on merits.
