Despite time having been granted since 2.11.2018, no counter affidavit has been filed by the State-respondents till date.
Learned counsel for the petitioner submits that the representation relating to the irregularity, committed in the allotment of housing site under the Pradhanmantri Gramin Awaas Yojna Rural, has been represented by the petitioner vide representation dated 23.9.2017 to the Collector Fatehpur (Annexure No.3 to the petition). He further submitted that subsequent representations have also been given, but till date, no decision has been taken.
Considering the facts and circumstances of the case and also the fact that the State-respondents have not filed any counter affidavit till date, we dispose off this writ petition with the direction to respondent No.2 - District Magistrate, Fatehpur, to take appropriate decision on the pending request of the petitioner referred to above strictly, in accordance with law, within a period of six weeks from the submission of a certified copy of this order.
Petitioner is at liberty to file fresh representation and also copies of the earlier representations alongwith certified copy of this order.
With the aforesaid directions, the writ petition is disposed off.
